2. Information on the processing of the data


Processing purposes and legal basis

The data collected as part of the questionnaire on the use of medical devices is used for the following purposes:

  • Name of physician and hospital:
    for questions about reported complications when using the medical device
  • Name of the person who completed the questionnaire:
    to confirm that all questions have been answered to the best of his/her knowledge (or on behalf of the physician and with his consent).
  • Technical information on the use of medical devices:
    for the clinical evaluation of the product with regard to safety and performance

All questionnaires are evaluated annually in anonymized form (percentage evaluation of how many participants made which statements).

Legal basis for processing

  • the name of the physician and the person who completed the questionnaire:
    Article 6 paragraph 1 a GDPR (consent),
  • the technical information on the use of medical devices:
    Article 6 paragraph 1 c GDPR (to fulfill a legal obligation to which the responsible person is subject) in conjunction with Article 83 of Regulation (EU) 2017/745 on medical devices.

Duration of storage

The data is continuously collected over the life of the medical product, since in addition to the annual analyzes, overall analyzes are also created for the individual products. A deletion therefore only takes place when the product is no longer on the market and no overriding legal regulation requires further storage of the data.

Data recipient

The analysis is incorporated into the clinical evaluation and is therefore also made available to the responsible certification body (“Notified Body”).

In the event of an audit, the “Notified Body” can also request access to the source data and in this case has access to the names given in the questionnaires.

Authorized read access to the platform on which the questionnaires are saved is given not only to the responsible GELITA MEDICAL employees, but also to the provider's support and distributors who are authorized by GELITA MEDICAL to act as distributors for GELITA MEDICAL in their respective country.


3. Your rights


You are informed about your rights to information, correction, deletion, restriction of processing, objection to processing and the right to data portability, which result from Articles 15 to 21 GDPR.

If the data processing is based on your consent, you have the right to withdraw your consent at any time without affecting the legality of the processing carried out on the basis of the consent up to the withdrawal.
